Tarpon Commission To Reconsider Wal-Mart Plan

TARPON SPRINGS - The City Commission voted Tuesday night to determine whether Wal-Mart's city-approved plan to develop one of its Supercenter retail complexes near the Anclote River has lapsed and will have to be reconsidered.

The issue is potentially so contentious the commission has set aside the evenings of Tuesday and Wednesday, Oct. 21 and 22, and the morning of Thursday, Oct. 23, to hear arguments and gather public comments on the status of the Wal-Mart development plan.

If the vote goes against Wal-Mart, its entire site plan for the store on U.S. 19 could be in jeopardy.
Commissioner will also have to decide whether the retailer can make amendments to its site plan for the roughly 200,000-square foot discount store-supermarket combo.

Commissioners agreed Tuesday to decide whether a key element of the development plan, called a certificate of concurrency, has expired. City Attorney James Yacavone has advised commissioners the certificate remains valid.

A certificate of concurrency states a planned development complies with the city's state-mandated comprehensive growth management plan and municipal land use regulations.

Yacavone has said the Wal-Mart site plan the City Commission approved in January 2005 remains valid and the city risks being successfully sued by Wal-Mart if it decided otherwise later this month.

An attorney for a private group opposing Wal-Mart's plan to build a store near the river maintains the development plan has lapsed because construction did not begin within one year of the plan's 2005 approval.
